Under the law, domestic violence is committed by a person who has been close to you in your life including: a spouse, or ex-spouse, members of your household (past and current), any current or former boyfriend or girlfriend, or the parent of your children (or expected child).
Domestic violence comes in many forms and can range from physical and sexual assault, to verbal, emotional and physical abuse. As used in the New Jersey Prevention of Domestic Violence Act, “Domestic violence” means the occurrence of one or more of the following acts inflicted upon a person protected under the act by an adult or an emancipated minor:
Criminal Sexual Contact
If you have been a victim of domestic violence, you can protect yourself in the short term by obtaining a temporary restraining order. This can be obtained through your local police station by way of a municipal court judge, or by going to the New Jersey Superior Court, Family Part, during business hours and applying for an Order. You should contact the attorneys at Cores & Associates as soon as the act of domestic violence occurs so that we can maximize the chance of protecting yourself, or defending yourself against false allegations.
After a temporary restraining order is granted, two things occur. First, the case will be scheduled for a Final Restraining Order hearing within 10 days. Preparation for this hearing is important and, therefore, you should contact the New Jersey Domestic Violence Attorneys at Cores & Associates as soon as you can. Second, the victim will have immediate protection from the abuser. If the alleged abuser contacts or comes near the victim, there is an automatic arrest and, in many cases, some jail time. These cases are incredibly important. Do not risk your safety or your freedom, contact the experienced attorneys at Cores & Associates when you are threatened or involved in a domestic violence case.
